Дисертація на здобуття наукового ступеня кандидата юридичних наук зі спеціальності 12.00.07 «Адміністративне право і процес; фінансове право; інформаційне право». – Національний університет біоресурсів і природо-користування України, Київ, 2017.
У дисертації проведено комплексне дослідження правового забезпечення проходження державної служби у органах юстиції України з метою формування цілісного уявлення про такий адміністративно-правовий феномен та пошуку ефективних нормативних засобів удосконалення даного процесу.
У межах роботи для розв’язання поставлених у ній завдань охарактеризовано сучасну нормативно-правову базу та проведено порівняльний аналіз окремих норм вітчизняного і зарубіжного законодавства, що регулюють процес проходження державної служби. Проаналізовано основні елементи системи державно-службових відносин, характерних для процесу проходження державної служби у органах юстиції України.
Основну увагу у роботі зосереджено на розкритті й удосконаленні теоретичних засад державної служби у органах юстиції у науці адміністративного (в перспективі – службового) права та нормативно-правового забезпечення організації, доступу, прийняття, проходження, кар’єрного зростання й припинення державно-службових відносин у органах юстиції України.
У результаті проведеного дослідження, спираючись на відповідний зарубіжний досвід, сформульовано теоретичні висновки та розроблено пропозиції щодо удосконалення механізму адміністративно-правового регулювання проходження державної служби у органах юстиції України

The thesis complex research of legal regulation of civil service in the judiciary Ukraine to form a holistic view of the administrative and legal phenomenon and finding effective legal means of improving the process. Within the work on the fulfillment of the tasks it carried out the following studies: describe the administrative and legal framework of the civil service to determine the complexity of its mechanism; the role and place of justice in the forming and state policies in Ukraine; using the existing legal framework and draft legislation, analyzes the nature of a public-relations official in the judiciary in the context of the civil service of Ukraine; formulated the legal basis for the emergence, change and termination of a public-relations official in the judiciary; identified the need for further development of the theoretical principles of public-relations official in the judiciary system standards institute official law. The proposals on the use of international experience in the formation of professional competence of civil servants of justice; justify the need to consolidate the legal implementation of the mechanism performance evaluation of civil servants to improve the quality of the personnel of Justice.
The focus of the work is focused on discovering and improvement of theoretical principles of public service in the judiciary in administrative science (in the future – official) law and regulation, administrative and legal framework of the civil service; place of justice in the civil law policy; Standards of forming official relations in the judiciary; the mechanism of the right to public service in the judiciary; professional development of civil servants of justice; grounds for termination of a public-relations official in the judiciary; resolution of the problems of official relations with the judiciary official rules of law; application of international experience in raising the professional level of personnel of justice; introducing a mechanism evaluating performance of civil servants of justice.
The result of the study, based on relevant international experience, formulated theoretical conclusions and suggestions for improvement of the mechanism of administrative and legal regulation of civil service in the judiciary Ukraine. In particular, the proposed adoption of the Service Code of Ukraine as a regulatory instrument of public-service relations and defining it features different these relations in various areas of public service, including the system of justice and within the industry: execution of criminal penalties, lawyers, notaries, registration service etc. An adoption of the Law of Ukraine «On State Service of Ukraine judicial authorities» to resolve the specific features of public-service relations, admission to the post only by competition; the establishment of the Institute professional development of employees in the performance of official duties; securing certification procedures and dismissal as a consequence of not passing the certification. Grounded making additions to the provisions of paragraph 5 of the Ministry of Justice of Ukraine to consolidate the mechanism of an annual assessment of the duties and tasks of employees of the judiciary and the development of individual provisions of the annual assessment of the duties and tasks of the civil servants of Justice of Ukraine. Were further developed formation principles of access to public services and defined the principle of social democracy, which represents social equality, justice, access to public services, compliance with which will lead to the establishment of greater understanding between public authorities and society and provide mutual consideration of interests of the state and citizens in their enrollment service, completion and passing the civil service
